Cheap as Chips Privacy Policy

1. Overview

1.1 Palcove Pty Ltd trading as Cheap as Chips ABN 46 055 118 404 and its related bodies corporate ("Cheap as Chips”, "we”, “our” or ”us”) recognise that your privacy is very important and we are committed to protecting your personal information. The Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (“APPs”) govern the way in which we treat your personal information.

1.2 This Privacy Policy ("Policy”) provides an outline of how we collect, use, hold, disclose and otherwise manage personal information regarding individuals ("you”, “your” or "users”) in connection with our business activities, including individuals who visit the website (cheapaschips.com.au).

1.3 This Policy has been prepared in accordance with the Privacy Act and “personal information” has the meaning given in the Privacy Act (which broadly means that in this Policy personal information means any information or opinion about an identified individual or an individual who is reasonably identifiable by us from the information we have access to).

1.4 This Policy applies to any personal information we collect and/or hold about you.

1.5 By giving your personal information to Cheap as Chips, or by visiting our website, opening a shopping account, transacting with us or registering as a member of or participating in our Loyalty Program, you are consenting to our collection, holding, use and disclosure of your personal information in accordance with this Policy and any other arrangements that apply between you and us. In this Policy, our “Loyalty Program” means the ‘Chippie Rewards’ customer loyalty and rewards program provided by Palcove Pty Ltd trading as Cheap as Chips ABN 46 055 118 404 as amended or renamed from time to time.

1.6 We reserve the right to change this Policy from time to time, including to take into account any changes to laws and technology, and changes to our operations and practices. Any updates of this Policy can be accessed via our website. Any updates of this Policy apply to any personal information and any other information we collect and/or hold about you. You should check our website regularly to ensure that you are aware of our current Privacy Policy.

1.7 Cheap as Chips also reserve the right to identify individual users or their browsing activities in the event that it is reasonably necessary for the enforcement of criminal law. In this case, we will comply with the APPs set out in the Privacy Act regarding the limits and protocols associated with disclosure of personal information in those circumstances.

 

2. Types of personal information we collect and hold

2.1 The types of personal information that we collect and hold will vary depending on your dealings with us and may include any or all of the following:

(a) Name, address(es) including residential and postal, email address, telephone number(s) and other contact details;

(b) Electronic address(es);

(c) Date of birth;

(d) System access passwords;

(e) Your device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information;

(f) Details of the products and services we have provided to you or that you have enquired about or that you have returned, including any additional information necessary to deliver those products and services and respond to your enquiries;

(g) Any additional information relating to you that you provide to us through our website or app or through your use of our website or app or online presence or through other websites or accounts from which you permit us to collect information;

(h) Information you provide to us through customer surveys;

(i) Details of your purchases and transactions with us including the form of payment used and details relating to your use of our products, services or benefits;

(j) Information relating to your application to register for or your registration as a member of our Loyalty Program, or your participation in and benefits under our Loyalty Program;

(k) Your Loyalty Program member number or barcode and other membership details, and barcodes for other offers made available to you;

(l) Standard employment information for recruitment purposes;

(m) Other personal information you provide us from time to time; and

(n) Other personal information required to provide our services or to facilitate your dealings with us or to verify your identity.

 

2.2 We may also collect your driver’s licence number where required (e.g. to comply with legal requirements).

2.3 We may collect sensitive information but only if you agree to provide it to us.  If you agree to provide us with sensitive information, we will only use it in accordance with the Privacy Act.

2.4 From time to time, you may provide us, and we may collect from you, personal information of a third party (for example, for delivery purposes or for Refer a Friend promotional campaigns).  Where you provide the personal information of a third party, it is your responsibility to ensure that those persons have authorised you to provide that information to us and are aware of this Privacy Policy, understand it and have accepted it and given the consents set out in it.

2.5 When you transact with us we keep a record of that transaction and any other transaction we can identify as related to you, including when you transact with us online as a “Guest”.

2.6 If you are 15 years old or older, we assume that you have the capacity to understand the contents of this Policy and provide the consents set out in this Policy.

 

2.7 You do not have to provide us with any personal information, however if you do not do so:

(a) we may not be able to provide you with the products, services or benefits you have requested; and

(b) you may not be able to join or participate in or receive any or some of the benefits of our Loyalty Program.

 

3. How we collect personal information

3.1 Generally, we collect personal information directly from you, such as:

(a) When you transact with us online or in-store;

(b) When you submit information or interact with us through our website;

(c) When you submit information or interact with us via our social media sites and smartphone applications;

(d) In person when you visit one of our stores;

(e) When you make a payment to us or we make a payment to you;

(f) When you join or register as a member of our Loyalty Program (or you apply to do so);

(g) When you participate in our Loyalty Program (including by earning or redeeming benefits provided under our Loyalty Program or otherwise interacting or transacting with our Loyalty Program);

(h) When you open a shopping account with us or sign up to receive our marketing campaigns or product catalogues;

(i) When you enter into a promotion conducted by us or a third party;

(j) When you complete a survey or provide feedback;

(k) When you order goods or services;

(l) In the course of us providing you with a requested product, service or benefit; or

(m) When you have other dealings with us or otherwise supply any information to us or communicate with us, online or in-store.

3.2 We also collect personal information about you from:

(a) Our related bodies corporate;

(b) Our business partners;

(b) Third parties through whom we advertise or sell our products and services; and

(d) Third parties who supply services to us.

3.3 In addition, when you apply for a job or position with us we may collect certain information from you (including your name, contact details, working history and relevant records checks) or from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract. This Privacy Policy does not apply to acts and practices in relation to employee records of our current and former employees, which are exempt from the Privacy Act.

 

4. Why we collect, hold, use and disclose personal information

4.1 We will use the personal information we collect or hold for the purposes disclosed at the time of collection, or otherwise as set out in this Policy or in other arrangements that apply between you and us.  We will not use your personal information for any other purpose without first seeking your consent, or where authorised or required by the law.

4.2 We may collect, hold, use or disclose personal information for the following purposes:

(a) To establish and maintain your relationship with us;

(b) To process payments;

(c) To provide the products and services you have requested;

(d) To allow you to use and access our services, website, social media and apps;

(e) To administer and provide you with the benefits of our Loyalty Program;

(f) To send you or make available marketing or promotional material that we think you might be interested in;

(g) To register you for events and promotions;

(h) To assist us to make our services and products more valuable or useful to you;

(i) To facilitate your dealings with us or to verify your identity;

(j) To operate, protect, improve and optimise our business, website and Loyalty Program;

4.3 We may disclose your personal information to third parties who work with us in our business for the purposes outlined above and otherwise in this Policy.

(a) Provide, promote or improve the products or service you have requested or that you are interested in; or

(b) Provide administrative support for our business or technical support for our systems and the services they provide to us; or

(c) Develop anonymised consumer insights so that we can better understand customer preferences.

4.5 These third parties may include:

(a) Manufacturers and suppliers;

(b) Marketing consultants and promotions companies;

(c) Consultants and professional advisers;

(d) Our related bodies corporate;

(e) Our business partners;

(f) Third parties through whom we advertise or sell our products and services;

(g) Third parties who supply services to us; and

(h) Other persons as required or as authorised or permitted by law.

 

5. Direct Marketing

5.1 We will also use and disclose your personal information to send direct marketing to you from us or our related bodies corporate.

5.2 The direct marketing may relate to:

(a) Our products and services;

(b) The products and services of other parties;

(c) Promotions run by us or other parties; or

(d) New developments or other products, services, events or things we believe may be of interest to you.

 

5.3 You may opt-out of receiving direct marketing through the unsubscribe function that will be made available to you with each direct marketing communication (or, if you are a member of our Loyalty Program, by logging into your account and opting-out).

 

6. How we hold and protect personal information

6.1 We store personal information in a combination of storage facilities, in electronic or hard copy form. Generally, we hold hard copy personal information at our premises in Australia and personal information in electronic form on our servers located in Australia or with service providers, on their servers located in Australia or the United States, who store and access your information to provide services to us.

6.2 In doing so, we have taken reasonable steps to protect your personal information from misuse, interference and loss, and unauthorised access, modification or disclosure.  Additionally, we use a number of physical, administrative, personnel and technical measures to protect your personal information and we take reasonable steps to destroy or de-identify personal information when we no longer need it for any purpose.

6.3 The internet is not a secure method of transmitting information.  Accordingly, other than where we use secure socket lay technology (SSL) to ensure information is securely transmitted and processed, we cannot and do not accept responsibility for the security of information you send to or receive from us over the internet, or for any unauthorised access or use of that information.

 

7. Do we send personal information overseas?

7.1 We use and store your personal information outside of Australia. We do this by employing trusted service providers to hold your information and to access your information to provide services to us. We do not disclose personal information to these overseas third parties for their own use.

7.2 Currently, those service providers who store and access your information overseas to provide services to us do so in the United States of America. We will update this policy if we appoint service providers who store or access the information in other countries.

 

8. Transacting with us online as a Guest

8.1 Typically, when you transact with us online as a “Guest” you may do so on an anonymous basis, however:

(a) when you transact with us as a Guest we keep a record of that transaction and any other transaction we can identify as related to you; and

(b) if the personal details that you input for the transaction match the details of a Loyalty Program member, then we may use those transaction details for the purposes of the Loyalty Program (and/or your shopping account) and provide benefits under the Loyalty Program to you in respect of that transaction.

 

9. Links

9.1 Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites. The privacy policies that apply to those other websites may differ substantially from our Policy, so we encourage you to read them before using those websites.

 

10. Cookies

10.1 Our website may use cookies to track user traffic patterns and to better serve you when you revisit a website. A cookie is a small data file that a website may write to your hard drive when you visit it. A cookie can contain information, such as a user ID which the website uses to track the pages you have visited. You can refuse all cookies by turning them off in your browser. However, full functionality for our website requires the use of cookies.

10.2 Information is also generated whenever a page is accessed on our website that records information such as the time, date and specific page. We may collect such information (which may include personal information) for statistical and maintenance purposes that enables us to continually evaluate our website performance. Any personal information collected in this way will be managed in accordance with this Policy.

 

11. How you can access your personal information and seek correction of it

11.1 We will take reasonable steps to make sure that the personal information we collect, use or disclose is accurate, complete and up to date. If your personal details change, such as your email address, delivery address or phone number, please login to your account online and update your details as soon as possible (or if you do not have an online login, please contact our Privacy Officer (contact details below) and provide your updated details).

11.2 At your request, we will provide you with a copy of any personal information which we hold about you, unless an exception under the Privacy Act applies.  We may charge a fee for retrieving this information, in which case we will inform you of the fee and obtain your agreement to that fee before providing the information.
